The rapidly evolving landscape of data and artificial intelligence (AI) regulation is currently navigating an era of significant transformation. In recent years, there has been an evident shift from merely focusing on data protection to grappling with a complex web of laws and regulations that now encompass both data and digital technology, particularly AI. This shift is happening as governments globally, including the UK, embark on initiatives like the new Data Use and Access Bill, which, while still in its nascent stages, suggests a movement towards a more cohesive regulatory strategy for the tech sector.

Historically, the regulation of personal data in the UK did not commence with the General Data Protection Regulation (GDPR) in 2018. The regulatory journey can be traced back to the 1998 Data Protection Act, which implemented directives stemming from the European Union’s (EU) framework on data protection. The GDPR, however, marked a major milestone by substantially increasing the punitive measures against non-compliance and bringing data protection into global discussions. Its impact has been echoed in numerous data protection laws worldwide, influenced largely by the GDPR’s model.

The EU has been at the forefront of this regulatory journey and has set a precedent that other regions have often followed. The introduction and global recognition of data protection concepts, rights, and obligations trace back to Europe, where the GDPR’s influence is unmistakable. A proliferation of similarly inspired legal frameworks has been observed globally, with jurisdictions increasingly requiring EU-style standard contractual clauses to regulate cross-border data transfers.

However, the regulatory journey of AI appears to be on a different trajectory. While AI technology has existed for many years without specific legal oversight, the advent of generative AI has intensified calls for regulation. Despite its longstanding presence, AI regulation, unlike data protection, does not yet have a unified global approach. The EU has recently introduced its AI Act, aiming once again to leverage a first-mover advantage similar to its earlier data protection laws. The swift introduction of the AI Act, compared to the GDPR, reflects the current urgency and interest surrounding AI technologies, albeit amidst considerable hype and expectation management.

Globally, regulatory approaches to AI vary, reflective of different regional priorities and philosophies. Anu Bradford, a professor at Columbia University, identifies three primary approaches: a company-driven model in the United States, a State-led approach in China, and a rights-driven framework in Europe. Each of these approaches presents distinct advantages and challenges. The debate continues over whether regulations should be risk-based or outcome-focused, and to what extent they should allow flexibility versus enforcement. Clear frameworks may facilitate enforcement but risk stifling innovation if too prescriptive.

As the world grapples with managing the potential and risks associated with AI, the path to cohesive regulation remains fraught with complexity. The evolving dialogue around AI regulation hints at wider unresolved questions about the balance between control and innovation in technology governance. With the global regulatory landscape still in flux, it remains to be seen how effectively regions can harmonize their efforts or if divergent strategies will continue to mark the path forward for AI governance.
