Governor Gavin Newsom signs AB 3030, mandating clear disclosure of AI-generated patient communications in a bid to improve transparency in healthcare by 2025.

In a significant move towards enhancing transparency in the healthcare sector, California Governor Gavin Newsom signed AB 3030 into law in September 2024. This legislation, set to take effect on January 1, 2025, is part of a broader suite of AI-related bills aimed at establishing a robust regulatory framework for artificial intelligence in the state.

AB 3030 specifically targets the use of Generative AI (GenAI) in health-related communications. The new law requires all health facilities, clinics, and physician practices that utilise GenAI for generating patient communications about clinical information to include specific disclosures.

These disclosures consist of two critical components:

  1. Disclaimer of AI Generation: Any communication generated by GenAI must clearly indicate its AI origin. This disclaimer must be integrated into the communication medium appropriately. For written formats like letters and emails, the disclaimer should be prominently placed at the beginning. In audio communications, the disclaimer should be verbally stated at both the start and end of the message. For video communications and continuous online interactions, such as chat-based telehealth, the disclaimer must remain visible throughout the entire exchange.

  2. Instructions for Human Contact: Communications must also provide straightforward instructions on how the recipient can contact a human healthcare provider or an appropriate staff member from the health facility or clinic.

These measures are applicable exclusively to communications involving “patient clinical information,” which specifically pertains to a patient’s health status. Administrative communications, such as those related to scheduling and billing, are exempt from these requirements. Additionally, if an AI-generated message is reviewed and approved by a licensed or certified human healthcare provider, the need for a disclaimer and instructions is waived.

Non-compliance with AB 3030 will attract penalties for the health facilities, clinics, or physician practices involved. These penalties could include fines and, potentially, actions against licensure. Physicians failing to adhere to the requirements might face disciplinary procedures concerning their licences.

Healthcare providers are advised to assess their current use of Generative AI in patient communications to ensure full compliance with the new legislation by evaluating their procedures and making necessary adjustments before the law comes into effect. The enactment of AB 3030 underscores California’s commitment to fostering an environment of transparency and accountability as AI becomes increasingly integrated into healthcare.
